This is an action for declaratory and monetary relief based on an arrest, search, seizure, and subsequent criminal prosecution which plaintiffs claim violated their constitutional rights. Jurisdiction is premised on determination of the federal constitutional rights underlying the claim, 28 U.S.C. Sec. 1331, as enforced by the Civil Rights Act, 42 U.S.C.
