This matter is before the Court for a decision on the merits after trial to the Court. Plaintiff brings this action in two counts. Count I alleges that defendant denied plaintiff a promotion to the position of supervisor on account of his race and national origin in violation of 42 U.S.C. § 2000e-2(a). Count II alleges that defendant retaliated against plaintiff in various ways for filing a charge of discrimination...
