This action was commenced on October 24, 1978, when plaintiffs, Dick and Joyce Saxe, filed a complaint alleging personal injury against the United States of America under the Federal Tort Claims Act, 28 U.S.C. §§ 1346(b) and 2671 et seq. (hereinafter FTCA), and the National Swine Flu Immunization Program of 1976 (hereinafter Swine Flu Act), formerly codified at 42 U.S.C. § 247b(j)-(l)...
