The facts in this case are not in dispute. Plaintiff was an employee of the Governor's Office of Manpower and Human Development (GOMAHD) as were the defendants. Defendant McDonough was an administrative assistant to the Director of GOMAHD, responsible for personnel matters. Defendant Stewart was employed as a Technical Advisor, responsible directly to the Director.
