The defendant, Kathleen Kaplan, appeals from the denial of her motion to dismiss a complaint charging her as an accomplice to second-degree murder. At the time the motion was filed, she had already pled guilty to the complaint but had not been sentenced. Subsequent to her plea, the named principal was tried and acquitted. The issue that we must decide is whether the doctrine of nonmutual collateral estoppel should be applied so as to bar the prosecution...
