OPINION BY PRESIDENT JUDGE CRUMLISH, March 4, 1983:

The Westmoreland County Common Pleas Court, by order, sustained Miscovich's appeal from the suspension of his driving privileges. The Department of Transportation (Department) appeals. We affirm.
