This is an action under Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e et seq., and under the Civil Rights Act of 1871, 42 U.S.C. § 1983. Defendants, City of Haverhill and its then-mayor Thomas Vathally ("employer"), allegedly discriminated against plaintiff on account of her sex in failing to hire her as a Health Department Code Enforcement Inspector ("inspector").
