Plaintiff, Peter Thornfield, filed suit against defendant to recover compensatory and punitive damages alleging defendant's employees made false and malicious statements which caused federal officials to bring criminal proceedings against him. From a judgment dismissing the complaint, entered pursuant to NMSA 1978, Civ.P.R. 37(B)(2) (Repl.Pamp. 1980), plaintiff appeals claiming abuse of discretion. We hold the trial court did not abuse...
