OPINION
REDDEN, District Judge:
Plaintiff Clifford Guerrero brings this action under 42 U.S.C. § 1983, asserting a violation of his constitutional rights. Trial was held at the Oregon State Penitentiary on October 4, 1983 and, pursuant to the agreement of the parties, additional testimony was taken by telephone October 11, 1983. No jury was requested.
