OPINION

Plaintiff has sued under the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. § 1001 et seq. for disability benefits denied to him by Defendant and a discretionary penalty of up to $100 per day that may be awarded for failure of a plan administrator to furnish information that ERISA mandates be furnished.
