INTRODUCTION:

This diversity action was brought to recover damages for injuries sustained by William E. Ryals Jr., at age 8, while he was playing on and around a pumping unit located on an oil and gas lease operated by defendant Alpha Oil & Gas, Inc. (hereinafter "Alpha").
