The question in this case is whether Ohio is now a "deferral state" within the meaning of the Age Discrimination in Employment Act (ADEA), 29 U.S.C. §§ 621 et seq. For the reasons outlined below, the Court holds that Ohio qualifies as a deferral state under 29 U.S.C. § 633(b), and as such deny defendant Edgcomb Metals Company's (Edgcomb) motion to dismiss for lack of subject matter...
