Defendant Hermes Shipping K.K. ("Hermes") has moved for summary judgment pursuant to Fed.R.Civ.P. 56 on the grounds that plaintiff Italia di Navigazione, S.p.A. ("Italia") is not the real party in interest and that certain of Italia's claims are time-barred.
