Appellee Charter Medical-Bibb County, Inc., (Charter Medical) applied to the State Health Planning and Development Agency (SHPDA) for a certificate of need approving the construction of a new hospital in the Macon area. Under the State Health Planning and Development Act, OCGA § 31-6-1 et seq. (Code Ann. § 88-3301 et seq.), the hospital could not be built without such a certificate.
