FEATHERSTON, Judge:

Respondent determined a deficiency in the amount of $3,836.74 in petitioner's Federal income tax for 1978. The sole issue for decision is whether petitioner recognized a loss arising from an allegedly substantially unequal division of community property upon his divorce.
