This appeal is taken from the dismissal of a complaint that sought to recover the damages suffered by the People of the State of Wyoming as a result of an oil spill into state waters. The basis for the dismissal was the failure to state a claim for which relief could be granted. The question for us to decide is whether the Wyoming Environmental Quality Act § 35-11-101, et seq., W.S. 1977, imposes strict liability for civil penalties upon the operator...
