Based upon our de novo review of this record we conclude that the requisite facts were established by clear and convincing evidence as required by Santosky v. Kramer, ___ U.S. ___, 102 S.Ct. 1388, 71 L.Ed.2d 599 (1982), and that the trial court did not err in terminating respondent's parental rights to Penny Irene Wagner, ORS 419.523; State ex rel. Juv. Dept. v. Farrell, 58 Or.App. 258,
