Plaintiff instituted this action on February 17, 1970 when it filed a complaint alleging that defendant had infringed two patents of which plaintiff was assignee. Defendant denied infringement and countered that the patents were invalid. Edward S. Graves, Esq., was appointed Special Master pursuant to Fed.R.Civ.P. 53, on June 17, 1970.
