This matter is before the court on Defendants' Motion to Dismiss Plaintiff's Second Amended Complaint.

On May 5, 1981, plaintiff Edmond DuSesoi (DuSesoi) filed a five count complaint in this court against the United Refining Company and its President, Harry A. Logan.
