On December 1, 1980, the defendant was charged by information with criminal mischief and arson, sections 45-6-101(1)(c) and 45-6-103(1)(a), MCA, respectively, both felonies, in the District Court of the Eighteenth Judicial District of the State of Montana, in and for the County of Gallatin.
