YOUNG, Judge.

This is an action to recover damages for a violation of the Public Accommodations Act, ORS 30.670 et seq.1 The trial court, sitting without a jury, found that racial slurs made by defendant's employee during the course of employment did not constitute a violation of the act and entered judgment for defendant. Plaintiff appeals, and we reverse.2
