The instant case was brought before this court through a motion for disbarment filed by the Office of Disciplinary Counsel (hereinafter the "petitioner") under Rule 16 of the Rules of the Supreme Court of the State of Hawaii. The respondent Donald S. Kagawa was a practicing attorney in Lihue, Kauai. Petitioner initiated these proceedings by filing several petitions with the Disciplinary Board of the Hawaii Supreme Court.
