This a personal injury case. Jurisdiction is founded on diversity of citizenship. The action arises out of an automobile accident which occurred on May 17, 1978 outside of Mineral Wells, Texas. Marilyn Isaacs Rothe was operating a 1977 Ford Pinto on U.S. Highway 281 when she lost control of the vehicle. The vehicle left the highway and struck two large trees.
