This matter is before the Court on Bruce D. Cummings' petition for writ of habeas corpus.

The facts of this case are not in dispute. On August 17, 1979, Cummings was found guilty by a jury of second degree murder and sentenced to life imprisonment in the Missouri Department of Corrections.
