On May 3, 1979, in Richmond County Superior Court, petitioner, a former sheriff of Richmond County, Georgia, was convicted on two counts of selling marijuana. Pursuant to 28 U.S.C. § 2254, and upon exhaustion of his state remedies, petitioner brought this action seeking issuance of a writ of habeas corpus.
