This is an appeal under a Rule 54(b) certification from an order dismissing a counterclaim for damages and attorney's fees. We reverse and remand.

Kenneth Lebel purchased a business property, Ken's General Store located at Theodore, from Norman Smith. Smith retained a real estate mortgage on the property.
