ORDER

LARKINS, Senior District Judge:

THIS MATTER comes before the Court on a Complaint and Motion For Temporary Restraining Order filed by Plaintiff to restrain Defendants from conducting City of Rocky Mount municipal elections on October 6, 1981. Plaintiff's Complaint alleges that Defendants violated his constitutional rights by refusing to place his name on the ballot. A hearing was held on October 5, 1981, in Trenton, North Carolina, at 10:00 A.M.
