This case arises out of the termination by the State of Alabama Highway Department of a contract with defendants. After the termination, the Highway Department made a final settlement with defendants. Plaintiff, as a subcontractor of defendants, claims that it is entitled to a portion of the proceeds of the settlement, and that defendants have refused to pay plaintiff.
