BUA, District Judge.
Presently before the court is Massarella's petition for a writ of habeas corpus. 28 U.S.C. § 2254. At a hearing on respondents' motion to vacate this court's April 1, 1980 Order setting bond, the parties agreed to submit the questions raised by the petition on the basis of the facts contained in their respective memoranda of law.
