On December 17, 1980, defendant Daniel Henderson was convicted after a jury trial in Superior Court, Somerset County, of arson with the intent to collect insurance proceeds in violation of 17-A M.R.S.A. § 802(1)(B).1 On appeal, defendant contends that, by reason of a prior trial, he has been twice in jeopardy in violation of the double jeopardy clauses of the Maine and United States Constitutions.
