The Borough of Wood-Ridge (borough) moved for leave to file a counterclaim beyond the time limits prescribed in response to the 1980 complaint filed by Curtiss-Wright Corporation (taxpayer). This motion and taxpayer's argument in opposition thereto presents to the Court the task of construing and applying to this situation various rules of procedure and oft cited decisions which are basic to the tax court practice.
