This matter comes before the court on the plaintiffs' joint motion for partial summary judgment under Rule 56(a). See Fed. R.Civ.P. 56(a). The plaintiffs contend that no material issues of fact remain with respect to their section 1981 claims. See 42 U.S.C. § 1981 (1976).
