This action arises under the Employee Retirement Income Security Act of 1974, 29 U.S.C. § 1001 et seq (ERISA). The Secretary of Labor has alleged that Defendants, trustees of the Michigan Carpenters' Council Vacation and Holiday Fund (the Plan), in cooperation with the Union that established the Plan have violated the Act by deducting union dues from monies in the Plan on a monthly basis while disbursing funds...
