This case comes before this Court on defendants' Rule 12(b) motion to dismiss. Defendants principally challenge the existence of subject matter jurisdiction, and contend that the Court should dismiss plaintiff's complaint in its entirety. Defendants additionally assert that even if the Court finds jurisdiction over the instant matter, several of the state claims set forth in plaintiff's complaint are not cognizable...
