Movant appeals from the denial of his Rule 27.26 motion without an evidentiary hearing.

Movant was convicted of rape in a jury trial in 1975 in St. Louis County, Missouri. At that trial, movant made no motion to quash the jury venire nor did he raise the issue of systematic exclusion of women on the jury panel. Any alleged error to the venire was lost by his failure to timely object to the jury panel at trial. State v. Phillips,
