This is a death case. Defendant was convicted of the forcible rape and murder of a twelve-year-old girl. The jury sentenced him to death for the murder, finding two aggravating circumstances. One, that the offense of murder was committed while defendant was engaged in the commission of another capital felony, to wit: rape. Code Ann. § 27-2534.1 (b) (2).
