This matter comes before this Court upon application by plaintiff for a preliminary injunction to enjoin defendant, P-Burg Coal Company, Inc., and any of its officers or agents from refusing to allow plaintiff's representatives onto defendant's mining operation in order to conduct inspections called for by the Surface Mining Control and Reclamation Act of 1977.
