Plaintiff originally filed an action in this Court, CIV-79-1325-D, on December 14, 1979. Said action was dismissed without prejudice by Plaintiff on July 22, 1980. Plaintiff then filed the instant action in the District Court of Custer County, Oklahoma, joining Joe McDaugale...
