This case is now before the Court for decision upon the merits. Plaintiff brought this suit pursuant to 28 U.S.C. § 13321 seeking declaratory relief as to its responsibilities with regard to lawsuits now pending in the state courts of Missouri. Defendant Lumbermens Mutual Insurance Company ("Lumbermens") subsequently counterclaimed and cross-claimed seeking similar declaratory relief.<...
