Defendant was found guilty by a jury on the second count of an indictment in which he was charged with having wilfully and knowingly attempted to evade and defeat a large part of an income tax due and owing by him and his wife for calendar 1971, by filing a false and fraudulent return which understated their taxable income by about $55,000.
