This case is now before the Court for decision on the merits. Initially, a hearing was scheduled to consider plaintiff's motion for a preliminary injunction. Subsequently, the parties agreed that the trial on the merits should be advanced and consolidated with the hearing on the motion for a preliminary injunction.
