We withdraw our former opinion handed down on 30 September 1980, and substitute this one in its place. In this opinion, we reach the same result and overrule the motion for rehearing.

In this action, Fred Haddad is the appellant and Virgil R. (Pete) Boon is the appellee. The controversy arose over the ownership of an undivided 1/32 non-participating royalty interest in and to certain gas-producing property...
