On September 29, 1978, petitioners were convicted of conspiring to commit arson and conspiring to defraud an insurer by reason of arson, after a joint trial by jury. These convictions were affirmed by the Supreme Judicial Court of Massachusetts. Commonwealth v. Allen, ___ Mass. ___, 400 N.E.2d 229 (1980).
