This is an action under the Vietnam Era Veterans' Readjustment Act of 1974 (hereinafter referred to as VEVRA or Act), 38 U.S.C. §§ 2021-2026 (1974), to obtain a lump sum separation allowance that was offered certain "protected" employees of the defendant, Norfolk & Western Railway Company (hereinafter referred to as Norfolk) under a Memorandum Agreement of May 1, 1976 (Memo 1976).
