BOOCHEVER, Justice.

Floyd Wortham was tried on counts charging him with blackmail of Katherine Owings and unlawful sale of a narcotic drug, cocaine. When the jury indicated that it had reached agreement on the drug count but could not agree on the blackmail count, the state agreed to dismissal of the latter charge.
