This is a declaratory judgment action brought by Emcasco Insurance Company (Emcasco) seeking to have the court declare its policy of insurance inapplicable to a one-car accident in which the automobile insured by Emcasco was involved. Emcasco requested that the court declare Emcasco was under no obligation to defend lawsuits arising out of the accident and that the defendants should be forever barred from asserting any claims against Emcasco.
