Before the court is a series of pre-trial motions in a four count narcotics indictment. Count One of the indictment charges Frank Cafaro, Anthony "Tony" Farrell, Howard Summers, Benjamin Moratti and Patricia Kelly with conspiracy to distribute Schedule II controlled substances in violation of 21 U.S.C. §§ 812, 841(a)(1) and 841(b)(1)(B).
