MEMORANDUM OPINION AND ORDER ON COLLATERAL ESTOPPEL
ATKINS, Chief Judge.
The issue before this Court is whether a transferee court after a 28 U.S.C. § 1407 transfer may prohibit those defendants who have not joined in the action from asserting the defense of collateral estoppel upon those cases' remand to the transferor court.
