Plaintiffs have brought this action alleging violations of the Labor-Management Reporting and Disclosure Act of 1959, 29 U.S.C. § 401 et seq. (the Act). Plaintiffs contend that the Defendants violated 29 U.S.C. § 411(a)(4) by fining Pawlak $2635.00 to recover the costs to Local 764 in defending a federal court action brought by Pawlak and dismissed because Pawlak did not exhaust internal union remedies.
