This is an appeal from a judgment of the district court of Stark County dismissing the complaint of John Kuhn.

Wendelin Kuhn and Rosa Kuhn were husband and wife, and during their marriage, they acquired certain personal property and real property consisting of a home in Richardton as well as farmland in Stark and Dunn Counties.
